HOSTEL LAGUNA SALA BY FSL
- PURPOSE
Under this contract, the Accommodation and Lodging Establishment HOSTEL LAGUNA SALA BY FSL (hereinafter, THE HOST) will provide accommodation services to the GUEST in the assigned room and/or dormitory, in exchange for a price and for the number of days indicated on the Accommodation Registration Card, page, Voucher, or any other means by which the reservation is made. In no case shall the period of stay exceed thirty (30) consecutive days.
- 1.1. Room Assignment: The room will be as indicated on the Accommodation Registration Card, page, or Voucher. THE HOST may change the room if the GUEST accepts and it is a room of equal or better conditions, or in the event of a fortuitous event or force majeure.
- 1.2. Times (Check-in / Check-out): Check-in time is from 2:00 p.m. on the day of arrival, and check-out time is until 12:00 p.m. on the day of departure. Early check-in or late check-out will be subject to availability, and the GUEST must pay the corresponding fee indicated at the hostel reception.
- 1.3. Independence of Use Time: Accommodation will be provided regardless of the actual time the GUEST remains in the room. Partial use of the room will incur payment of the full rate.
- 1.4. Service Availability: The provision of the services subject to the contract, as well as any complementary services offered by the Hostel, will be subject to availability and to the schedules, shifts, or physical stock of supplies, goods, facilities, or spaces designated for them. The room and/or dormitory and the price or rate per night will be those indicated on the Accommodation Registration Card corresponding to the reservation.
- PRICE
- 2.1. Accommodation Fee: The price of this contract corresponds to the nightly fee that the GUEST is obliged to pay, which amounts to the sum indicated on the Accommodation Registration Card, page, or Voucher corresponding to the reservation made. All of the above will be described on the corresponding invoice, unless the reservation was made and paid through an online travel agency (OTA), in which case the rate will be as agreed directly with said agency.
- 2.2. Additional Charges: The GUEST must also pay all charges for food, beverages, laundry, and, in general, for all consumption generated during their stay that they choose to charge to their account.
- 2.3. Knowledge of Rates: The GUEST declares that they have been duly informed of the rates, fees, and, in general, the prices of the rooms per night.
- 2.4. Payment Default: Failure to make the agreed payment will result in the GUEST being charged late interest at the maximum legal rate allowed.
- OBLIGATIONS
3.1. Of THE HOSTEL
- 3.1.1. Provide the service subject to this contract.
- 3.1.2. Attend to, receive, process, and respond to suggestions, complaints, or claims submitted by the GUEST.
- 3.1.3. In accordance with Article 1195 of the Commercial Code, the HOSTEL will be obliged to safeguard money and objects that, at the request of the GUEST, are handed over for safekeeping. The establishment may only refuse to receive them if they are objects of high value or excessively bulky.
3.2. Of THE GUEST
- 3.2.1. Identification: Properly identify themselves to register at the HOSTEL with a suitable identification document, presenting their citizenship card if Colombian, or their passport or applicable document if foreign. For minors, the identification document proving kinship with the service contracting person and/or the authorization duly signed by the minor’s parents must be presented.
- 3.2.2. Payment for Accommodation: Pay the accommodation fee plus corresponding taxes.
- 3.2.3. Payment for Consumption: Pay the value of all consumption and extra charges made to their account.
- 3.2.4. Behavior: Maintain decorous, respectful conduct and dress appropriately within the facilities.
- 3.2.5. Civil Liability: Be liable for even slight negligence in their obligations and those of their companions or guests.
- 3.2.6. Visitor Registration: Register all companions or guests visiting their room at the HOSTEL reception and pay the corresponding fee or value for each of them.
- 3.2.7. Occupancy Limit: Respect the maximum number of people allowed per room.
- 3.2.8. Exemption for Risky Activities: The GUEST acknowledges that the practice of sports, physical exercises, use of instruments or tools, and, in general, any activity that entails a risk or may be considered dangerous, will be their decision under their exclusive responsibility. This implies that the GUEST has the skills and knowledge that allow them to assume such risks, exempting the HOSTEL and its officials or employees from any responsibility in case of suffering harm or injury.
- 3.2.9. Care of Establishment Property: Use the furniture, fixtures, equipment, and, in general, the facilities of both the room and the HOSTEL appropriately, keeping them in their existing condition. Therefore, they will be liable for even slight negligence for any damage or loss of the establishment’s items and property. In case of loss, total or partial damage attributable to the GUEST or their companions, they must pay the corresponding price for its repair or replacement, as the case may be.
- 3.2.10. Respect for Authority: Respect the authority of the Manager and administrators of the HOSTEL.
- 3.2.11. Inspection and Surveillance: Allow the right of inspection and/or surveillance of the room by HOSTEL staff. This right will be exercised reasonably and includes the faculty to enter or search the room when, in the judgment of the HOSTEL Manager, it is strictly necessary or urgent.
- 3.2.12. Staff Access: Allow HOSTEL employees and staff access for routine cleaning and maintenance of the room.
- 3.2.13. Custody of Belongings and Lockers: It is the GUEST‘s duty to safeguard their personal belongings. In shared rooms, the GUEST must store their valuables in the assigned drawer (locker) for their bed, using their own padlock. The HOSTEL is not responsible for the loss, misplacement, or theft of belongings in shared rooms or common areas due to the guest’s own carelessness or failure to use the provided security drawers. Likewise, the establishment is not responsible for food or beverages left in common areas, refrigerators, or shelves. If the GUEST checks out and leaves behind any food, beverage, or belonging, they authorize the HOSTEL administration to dispose of these items without any claim.
- CONTRACT TERMINATION
The accommodation contract will terminate due to the following events:
- 4.1. Upon expiration of the agreed term.
- 4.2. For breach of any of the obligations of the parties; specifically, for the GUEST‘s failure to pay the fee, or for non-payment of food, beverages, or other complementary services charged to the room or their personal account.
- 4.3. In events where, in the exclusive judgment of the HOSTEL, the GUEST‘s behavior or attire violates the tranquility, morality, good customs, and/or health of other guests, collaborators, or visitors of the establishment.
- 4.4. For smoking in the room or any other smoke-free area of the HOSTEL, when it affects other guests, visitors, or users, and without prejudice to the established economic sanctions.
Paragraph: Early termination of the contract does not exempt or release the GUEST from paying outstanding commercial balances owed to the establishment.
- EFFECTS OF TERMINATION
- 5.1. Space Release: Upon termination of the contract, the HOSTEL may freely dispose of the room and/or dormitory.
- 5.2. Luggage Removal: Regardless of the cause of termination, the HOSTEL is fully authorized to enter the room, prepare and sign an inventory of the guest’s personal effects and luggage, and remove them from the room to place them in a secure deposit, at the sole expense and risk of the GUEST.
- 5.3. Right of Retention and Sale: If the GUEST does not pay the bill or part of it, the HOSTEL may dispose of and sell the GUEST‘s luggage and objects under the terms of Article 1199 of the Commercial Code to cover outstanding obligations with the proceeds. Any surplus, if any, will be made available to the debtor. Should a debit balance (deficit) result, the HOSTEL may initiate corresponding legal actions to secure full payment of the owed sum.
- MISCELLANEOUS PROVISIONS
- 6.1. Legal Nature: In accordance with Article 79 of Law 300 of 1996, the accommodation contract is a commercial and adhesion lease contract.
- 6.2. Proof of Contract and Enforceability: The accommodation contract is proven by the Hotel Registration Card issued by the HOSTEL, which, when signed by the GUEST, confirms their adherence to the stipulations contained herein. The GUEST expressly accepts that the liquid sum of money stated on the commercial invoice will constitute an enforceable instrument.
- 6.3. Prevention of Child Sexual Exploitation: The HOSTEL strictly rejects and prohibits the exploitation, tourism, and any form of sexual abuse of girls, boys, and adolescents. The GUEST may not bring minors under eighteen (18) years of age into their room for purposes of sex tourism. Anyone engaging in such conduct will be reported to the relevant authorities and faces prison sentences of 14 to 25 years and fines of 67 to 750 SMLMV (penalties that will be increased by up to half if the victims are under 12 years old), as provided in Law 679 of 2001.
- 6.4. Smoke-Free Policy: In consistency with environmental and health care, all rooms and common areas of the HOSTEL are smoke-free spaces. Smoking in rooms or unauthorized areas constitutes a serious breach of contract, entitling immediate termination and removal of the guest. Non-compliance with this rule (based on Resolution 1956 of 2008) will additionally incur an economic penalty or surcharge of $150,000 COP.
- 6.5. Protection of Flora, Fauna, and Heritage: The HOSTEL promotes compliance with Resolution 572 of 2005 and other regulations for the conservation of wild flora and fauna. Likewise, it promotes the protection of cultural heritage and assets of cultural interest in compliance with Law 397 of 1997.
- 6.6. Non-Discrimination: The HOSTEL rejects any form of discrimination, distinction, exclusion, restriction, or preference based on gender, race, color, national or ethnic origin, religion, sexual orientation, political opinion, or any other condition whose purpose or result is to limit the enjoyment of fundamental rights.
- 6.7. Registration of Minors: If the GUEST arrives at the establishment with minors under 18 years of age, they have the strict obligation to inform this and present the Civil Birth Registry proving kinship. If the minors are not traveling with their parents, the GUEST must submit to reception, along with the Civil Registry, the travel permit granted by the parents, duly authenticated by a Public Notary and accompanied by a copy of the identification documents of those authorizing. Without this documentation, the minor will be absolutely denied entry to the establishment.
- 6.8. Entry of Alcoholic Beverages (Corkage): The entry of external alcoholic beverages into the establishment is not permitted. Should the client wish to bring them in, they must pay a corkage fee equivalent to $35,000 COP per bottle.
- 6.10. Coexistence and Respect: All guests must maintain polite, peaceful, and respectful conduct towards other users, workers, and visitors throughout their stay within the facilities.
- 6.11. Quiet Hours: To ensure everyone’s rest, strict quiet hours within the rooms and social areas are between 12:00 a.m. and 6:00 a.m.
PRIVACY NOTICE AND AUTHORIZATION FOR THE PROCESSING OF PERSONAL DATA
By signing this contract, the GUEST expressly authorizes the establishment HOSTEL LAGUNA SALA BY FSL, identified with NIT: 901189524-8, to collect, store, and use the information and personal data provided on the Accommodation Registration Card. Said data (such as name, identification, address, nationality, date of birth, email, telephone numbers, economic activity, and personal preferences) will be processed in accordance with the company’s internal policies and current legal regulations.
The purpose of the processing is to carry out loyalty activities, evaluate service quality through post-stay surveys, send invitations, commercial offers, promotions, and the establishment’s service portfolio. The GUEST authorizes this information to be transmitted or shared with commercial partners exclusively for the purposes described above.
As the owner of personal data, the GUEST will enjoy the rights enshrined in Article 8 of Law 1581 of 2012; in particular, to know, access, update, rectify their data, or revoke authorization for processing at any time.
